The company's been prosecuted for selling noodles containing nuts to a customer with a serious allergy.

The former restaurant on Endless Street has been ordered to pay £10,722.13, including costs, following a hearing at Swindon Magistrates Court.

Koh (UK) Ltd had previously admitted selling 'food not of the substance demanded by the customer' and being prosecuted by Wiltshire Council under the Food Safety Act 1990.

The restaurant took an order via the Just Eat app in December 2017, with the customer stating on their order that they had a nut allergy.

But the chicken soya noodles that arrived contained peanuts.

Barrister Syan Venton, who was acting on behalf of Wiltshire Council, told the court:

"The restaurant received this important information but it was not conveyed to the kitchen."


The customer suffered an allergic reaction after just one mouthful of the dish and took medication.

Despite that, she continued to suffer stomach pains, swollen lips and a swollen tongue.

'Deficiencies' in the kitchen system were found during an investigation by Wiltshire Council's environmental health team.

Jerry Wickham, Wiltshire Council cabinet member for public protection said:

"The fine and costs of over £10,000 illustrates the severity with which this case was viewed by the Magistrates and Wiltshire Council who initiated this prosecution. The customer was remarkably lucky that they did not lose their life, as has tragically happened in other cases.

"Customers must always feel confident when ordering food and highlighting food allergies, that their requirements are taken seriously by food outlets. It is very clear there were avoidable failings in this case and the fine must serve as a stark reminder to all food outlets."

Salisbury's Koh Thai restaurant closed in January 2019.
